Quebec’s Privacy Law vs the new GLBA Safeguards Rule: How Do They Stack Up?

Quebec’s Bill 164: the Act Respecting the Protection of Personal Information in the Private Sector proposes granting new rights to individuals regarding data portability, the right to be forgotten and the right to de-indexation. In order to implement and uphold these rights, many companies will have to modify their business processes or adopt new ones. Once adopted, the Bill will result in significant changes to various laws in order to modernize the regulatory framework for the protection of personal data in Quebec.

The new GLBA Safeguards/Privacy Rule protects a consumer’s “nonpublic personal information” (NPI). NPI is any “personally identifiable financial information” that a financial institution collects about an individual in connection with providing a financial product or service, unless that information is otherwise “publicly available.”
